Attorney General Fepulea’i Afa Ripley Jr. offered his apology to the High Court yesterday for granting the release of Makuisa Amotai from the Territorial Correctional Facility for Mother’s Day weekend.  Amotai, a retied police veteran, was found guilty for vehicular homicide and was sentenced by the High Court last month to 20 months in jail without release, except for an emergency or by court order. The detention period is a condition of Amotai’s five year probation.
                            
On the day Amotai was sentenced to jail, the Probation Officer said Amotai spent 25 minutes at TCF and was then released for Mother’s Day weekend. Upon discovering this, the probation officer petitioned the high court to revoke Amotai’s probation since he had violated the court’s order.

Fepulea’i told the High Court that he was not aware that Amotai was already in jail, and therefore allowed Amotai to spend Mother’s Day weekend with his family under the impression that he would then be reporting to jail to serve his sentence.  He said that after Amotai’s sentencing on May 9, Amotai’s attorney Fiti Sunia requested that his client be allowed to spend Mother’s Day with his family, after which he would report to jail on the evening of May 11. Fepulea’i said he was told that the Court had placed Amotai in the government’s custody, and that he was therefore under the impression that the government has discretion over the defendant.

Fepulea’i told the High Court that he realizes it was a misjudgment on his part and his apology and explanation was accepted by Chief Justice Michael Kruse.  Kruse said that the court does not sit well when Senior members of the Bar think they can do whatever they want, and therefore he does not expect a repeat of what happened.
